Taxation Portal is a Tax related Services Provider. As a client availing Taxation Portal services, you agree to the following terms and conditions:

Since we will not be meeting face to face, it is important to set out the terms of the agreement clearly in advance.

If you have any queries about Taxation Portal, please do not hesitate to contact us. In this agreement, we have referred to the Taxation Portal service as the “service”, to you as the “user” and to our agreement as the “agreement”. The term “Advisor” in this agreement shall mean advocates/ advisors, Chartered Accountants and Company Secretary.

Goods and Services Tax (GST) is applicable to our fees. A GST e-Invoice and Input Tax Credit will be provided if you provided GSTIN at time of payment. It is the clients responsibility to ensure GSTIN is provided at the time of payment to receive GST Input Tax Credit.

  1. TaxationPortal.inONLY PROVIDES A MEDIUM FOR INTERACTION

Taxation Portal is an internet portal that facilitates communication between professionals and potential users of professional services. Taxation Portal acts as a venue for providers and consumers of professional services to exchange information with the goal of eventually forming a professional relationship. Taxation Portal does not guarantee that users will successfully find an Advisor through this system. Taxation Portal takes no position and offers no opinion on when or if an Advisor-client relationship has been formed.

In order to provide an optimal forum for advisors and clients, Taxation Portal does not involve itself in the agreements between Advisors and clients or the actual representation of clients. Therefore, we cannot ensure the completion of the agreement or the integrity of either party. The user, and not Taxation Portal, is solely responsible for assessing the integrity, honesty, and trustworthiness of all persons with whom the user communicates on this service. Each advisor have their own terms and conditions and users are advised to go through the same before engaging with such advisors.

1) Terms & Conditions that govern the usage of TaxationPortal.in

Welcome to TaxationPortal.in. This website is owned and operated by Taxation Portal H-173 Near Bismillah Masjid, Jaitpur Ext. 2, New Delhi 110044 India. By visiting our website and accessing the information, resources, services, products, and tools we provide, you understand and agree to accept and adhere to the following terms and conditions as stated in this policy (hereafter referred to as ‘User Agreement’), along with the terms and conditions as stated in our Privacy Policy (please refer to the Privacy Policy section below for more information).

We reserve the right to change this User Agreement from time to time without notice. You acknowledge and agree that it is your responsibility to review this User Agreement periodically to familiarize yourself with any modifications. Your continued use of this site after such modifications will constitute acknowledgment and agreement of the modified terms and conditions.

Taxation Portal does not promote any User.

Taxation Portal seeks to help every needy litigant find advisors best suited to his/her needs. Taxation Portal is not intended to be a source of advertising or solicitation and the contents of the website should not be construed as professional advice. Taxation Portal may recommend subscribing advisors if they match a user’s requirements, but not otherwise. Transmission, receipt or use of Taxation Portal does not constitute or create an advisor-client relationship. No recipients of content from this website should act, or refrain from acting, based upon any or all of the contents of this site. We welcome the user to study the profiles of advisors independently and make an informed choice.

ENTIRE AGREEMENT

This agreement constitutes the entire and whole agreement between user and Taxation Portal, and is intended as a complete and exclusive statement of the terms of the agreement. This agreement shall supersede all other communications between Taxation Portal and its users with respect to the subject matter hereof and supersedes and replaces all prior or contemporaneous understandings or agreements, written or oral, regarding such subject matter. If at any time you find these Terms and Conditions unacceptable or if you do not agree to these Terms and Conditions, please do not use this Site. We may revise these Terms and Conditions at any time without notice to you. It is your responsibility to review these Terms and Conditions periodically.

    • RESPONSIBLE USE AND CONDUCTS
      • Accessing (or attempting to access) any of our Resources by any means other than through the means we provide, is strictly prohibited. You specifically agree not to access (or attempt to access) any of our Resources through any automated, unethical or unconventional means.
      • Engaging in any activity that disrupts or interferes with our Resources, including the servers and/or networks to which our Resources are located or connected, is strictly prohibited.
      • Attempting to copy, duplicate, reproduce, sell, trade, or resell our resources is strictly prohibited.
      • You are solely responsible for any consequences, losses, or damages that we may directly or indirectly incur or suffer due to any unauthorized activities conducted by you, as explained above, and may incur criminal or civil liability.
      • In order to access our Resources, you may be required to provide certain information about yourself (such as identification, email, phone number, contact details, etc.) as part of the registration process, or as part of your ability to use the Resources. You agree that any information you provide will always be accurate, correct, and up to date.
      • You are responsible for maintaining the confidentiality of any login information associated with any account you use to access our Resources. Accordingly, you are responsible for all activities that occur under your accounts. Taxation Portal Private Limited’s service obligation is considered complete once access to our platform is granted. All subsequent responsibilities and the final outcome of the service are solely the client’s responsibility.
      • We may provide various open communication tools on our website, such as blog comments, blog posts, public chat, forums, message boards, newsgroups, product ratings and reviews, various social media services, etc. You understand that generally we do not pre-screen or monitor the content posted by users of these various communication tools, which means that if you choose to use these tools to submit any type of content to our website, then it is your personal responsibility to use these tools in a responsible and ethical manner. By posting information or otherwise using any open communication tools as mentioned, you agree that you will not upload, post, share, or otherwise distribute any content that:
        • Is illegal, threatening, defamatory, abusive, harassing, degrading, intimidating, fraudulent, deceptive, invasive, racist, or contains any type of suggestive, inappropriate, or explicit language;
        • Infringes on any trademark, patent, trade secret, copyright, or other proprietary right of any party;
        • Contains any type of unauthorized or unsolicited advertising;
        • Impersonates any person or entity, including any www.TaxationPortal.in employees or representatives.
    • We have the right at our sole discretion to remove any content that, we feel in our judgment does not comply with this User Agreement, along with any content that we feel is otherwise offensive, harmful, objectionable, inaccurate, or violates any 3rd party copyrights or trademarks. We are not responsible for any delay or failure in removing such content. If you post content that we choose to remove, you hereby consent to such removal, and consent to waive any claim against us.
      • We do not assume any liability for any content posted by you or any other 3rd party users of our website. However, any content posted by you using any open communication tools on our website, provided that it doesn’t violate or infringe on any 3rd party copyrights or trademarks, becomes the property of www.TaxationPortal.in, and as such, gives us a perpetual, irrevocable, worldwide, royalty-free, exclusive license to reproduce, modify, adapt, translate, publish, publicly display and/or distribute as we see fit. This only refers and applies to content posted via open communication tools as described, and does not refer to information that is provided as part of the registration process, necessary in order to use our Resources. All information provided as part of our registration process is covered by our Privacy Policy.
      • You agree to indemnify and hold harmless Taxation Portal.in a digital property of Taxation Portal and its parent company and affiliates, and their directors, officers, managers, employees, donors, agents, and licensors, from and against all losses, expenses, damages and costs, including reasonable attorneys’ fees, resulting from any violation of this User Agreement or the failure to fulfill any obligations relating to your account incurred by you or any other person using your account. We reserve the right to take over the exclusive defense of any claim for which we are entitled to indemnification under this User Agreement. In such event, you shall provide us with such cooperation as is reasonably requested by us.
    • PRIVACY

Your privacy is very important to us, which is why we’ve created a separate Privacy Policy in order to explain in detail how we collect, manage, process, secure, and store your private information.     • LIMITATION OF WARRANTIES

By using our website, you understand and agree that all Resources we provide are “as is” and “as available”. This means that we do not represent or warrant to you that:

    • LIMITATION OF LIABILITY

In conjunction with the Limitation of Warranties as explained above, you expressly understand and agree that any claim against us shall be limited to the amount you paid, if any, for use of products and/or services. www.TaxationPortal.in will not be liable for any direct, indirect, incidental, consequential or exemplary loss or damages which may be incurred by you as a result of using our Resources, or as a result of any changes, data loss or corruption, cancellation, loss of access, or downtime to the full extent that applicable limitation of liability laws apply.

    • COPYRIGHTS / TRADEMARKS

All content and materials available on www.Taxation Portal.in, including but not limited to text, graphics, website name, code, images and logos are the intellectual property of Taxation Portal, and are protected by applicable copyright and trademark law. Any inappropriate use, including but not limited to the reproduction, distribution, display or transmission of any content on this site is strictly prohibited, unless specifically authorized by Taxation Portal.

    • TERMINATION OF USE

You agree that we may, at our sole discretion, suspend or terminate your access to all or part of our website and Resources with or without notice and for any reason, including, without limitation, breach of this User Agreement. Any suspected illegal, fraudulent or abusive activity may be grounds for terminating your relationship and may be referred to appropriate law enforcement authorities. Upon suspension or termination, your right to use the Resources we provide will immediately cease, and we reserve the right to remove or delete any information that you may have on file with us, including any account or login information.

    • GOVERNING LAW

This website is controlled by Taxation Portal from our offices located in the state of New Delhi, India. It can be accessed by most countries around the world. As each country has laws that may differ from those of New Delhi, India by accessing our website, you agree that the statutes and laws of New Delhi, India without regard to the conflict of laws and the United Nations Convention on the International Sales of Goods, will apply to all matters relating to the use of this website and the purchase of any products or services through this site.

Furthermore, any action to enforce this User Agreement shall be brought in the federal or state courts located in New Delhi, India. You hereby agree to personal jurisdiction by such courts, and waive any jurisdictional, venue, or inconvenient forum objections to such courts.

UNLESS OTHERWISE EXPRESSED, www.Taxation Portal.in EXPRESSLY DISCLAIMS ALL WARRANTIES AND CONDITIONS OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES AND CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.

Terms & Conditions applicable to our Incorporation, Startup and Registration services

  • For bank account or payment services, your name, phone number, and email will be shared with a bank of your choice, with your consent. Banks reserve the right to open or decline your request based on their policy.
  • If you wish to register a Partnership Firm with the Registrar of Firms of the respective states, additional charges as applicable, will be payable and conveyed upfront.
  • Up to 4 name options can be provided in one RUN name approval request.
  • Authorized capital is the number of shares a company can issue at any time, which can be increased further. Paid-up capital is the amount shareholders invest, which can be even Rs.2.
  • Statutory Auditor fees are payable on actuals directly to the Independent Auditor appointed by the Board of Directors. All companies must appoint an Independent Statutory Auditor of their choice within 30 days of incorporation.
  • Taxation Portal provides 2 DSC Hyper Token & support for KYC and DSC shipping with each incorporation. As per CCA Guidelines as on 15th July, 2024, the DSC Application will have to make direct payment to the Certifying Authority for certificate and KYC.
  • Additional authorised capital can be purchased if required at the time of incorporation. The price for additional authorised capital can be provided upon request.
  • Clients are responsible for paying stamp duty, which varies depending on the state of incorporation and the company’s registered capital. Below is a detailed list of stamp duty charges based on State and capital range:

  • The following Terms & Conditions apply to Refunds and Cancellations
  • At Taxation Portal, we take pride in the services delivered by us and guarantee your satisfaction with our services and support. We constantly improve and strive to deliver the best accounting, financial or secretarial services through the internet. However, in case you are not satisfied with our services, please contact us immediately and we will correct the situation, provide a refund or offer credit that can be used for future Taxation Portal orders.

If you’re not satisfied with the service, Please Contact us for the engagement to initiate the refund process. All help by members of the Senior Management and personally responded within 24-48 hours.

      • Refund Policy

Taxation Portal service obligation is considered complete once access to our platform is granted. All subsequent responsibilities and the final outcome of the service are solely the client’s responsibility. It is the clients responsibility to ensure accuracy and correctness. Hence, Taxation Portal will not pay any penalties or taxes on behalf of its clients. Further, Taxation Portal is not responsible or liable for any other cost incurred by the client related to the completion of the service or the final outcome of service.

Refunds are subject to a 20% cancellation charge.

      • Procedure for Requesting Refund

Refund request can be initiated through Taxation Portal Platform. To request a refund, please request a refund in the concerned chat room to the relevant engagement manager. All refund requests must be made within 30 days of purchase. Refund request over 30 days will not be accepted and only credit will be provided for completion of service / change of service. We will complete processing your refund request within 4 to 5 weeks of receiving all the information required for processing refund like reason for refund, bank details for processing request, etc.

      • Change of Service

If you want to change the service you ordered for a different one, you must request this change of service within 7 days of purchase.

      • Standard Pricing

Taxation Portal has a standard pricing policy wherein no additional service fee is requested under any circumstance. However, the standard pricing policy is not applicable for an increase in the total fee paid by the client to Taxation Portal due to increase in government fee or fee incurred by the client for completion of legal documentation or re-filing of forms with the government due to rejection or resubmission. Taxation Portal is not responsible or liable for any other cost incurred by the client related to the completion of the service.

      • Factors Outside our Control

We cannot guarantee the results or outcome of your particular procedure. For instance, the government may reject a trademark application for legal reasons beyond the scope of Taxation Portal service. In some cases, a government backlog or problems with the government platforms (e.g. MCA website, Income Tax website, FSSAI website) can lead to long delays before your process is complete. Similarly, Taxation Portal does not guarantee the results or outcomes of the services rendered by our Associates on Nearest.Expert platform, who are not employed by Taxation Portal. Problems like these are beyond our control and are not covered by this guarantee or eligible for refund. Hence, delay in processing of your file by the Government cannot be a reason for refund.

      • Force Majeure

Taxation Portal shall not be considered in breach of its Satisfaction Guarantee policy or default under any terms of service, and shall not be liable to the Client for any cessation, interruption, or delay in the performance of its obligations by reason of earthquake, flood, fire, storm, lightning, drought, landslide, hurricane, cyclone, typhoon, tornado, natural disaster, act of God or the public enemy, epidemic, famine or plague, action of a court or public authority, change in law, explosion, war, terrorism, armed conflict, labor strike, lockout, boycott or similar event beyond our reasonable control, whether foreseen or unforeseen (each a “Force Majeure Event”).

      • Cancellation Fee

Since we’re incurring costs and dedicating time, manpower, technology resources and effort to your service or document preparation, our guarantee only covers satisfaction issues caused by Taxation Portal – not changes to your situation or your state of mind. In case you require us to hold the processing of a service, we will hold the fee paid on your account until you are ready to commence the service.

  • The following Terms & Conditions apply to Tax and Compliance services

      • Taxation Portal will provide services based on the packages availed by the client. Invoices will be issued periodically.
      • The final pricing of the services provided will be contingent upon the Goods and Services Tax (GST) scheme opted for by the client with the relevant tax authorities.
      • CA verification of the Income Tax Return will incur separate charges.
      • The Client is responsible for verifying the accuracy, reliability, and completeness of all information in returns/filings as well as the accounting records and particulars furnished, prior to approval and signature.

The Client is also obliged to disclose all material and relevant information.

Taxation Portal shall not be held liable for any issues that may arise from incorrect or incomplete information provided by the Client.

    • All data provided by the Client will be kept confidential by Taxation Portal and not disclosed to third parties without your consent, except as mandated by law, court order, or professional obligation.

Should you grant us permission to disclose your confidential information under specific circumstances or set conditions on such disclosures, we will comply by disclosing the relevant information as permitted in the course of providing our services, unless otherwise directed by you in writing.

    • The client will be responsible for paying all government fees, penalties, statutory audit fees, and taxes related to the engagement on actuals. Taxation Portal Accountants will solely be responsible for the preparation of accounting records and statutory returns.
    • Clients are required to provide reasonable access to relevant individuals and documents, and are responsible for the completeness and accuracy of the information supplied to us.
    • Any advice provided is based on an opinion formed from understanding the client’s specific circumstances.
    • The client should be aware of the due dates and required compliances under various laws, acts, regulations, and rules. The client is solely responsible for adhering to all applicable legal compliances and will be liable for any penalties or losses incurred due to non-compliance with any applicable laws, rules, regulations, and acts.
    • Pricing for GST Return, TDS, ITR Return, and PF Return filing is applicable to businesses with a turnover up to INR 25 lakhs and a workforce of 20 employees. Additional charges will be incurred for businesses exceeding these thresholds.
  • Terms & Conditions apply to our Intellectual Property services like trademark, patent and copyright.
    • Prices unless mentioned otherwise are for one class. Any additional class will be chargeable extra.
    • Taxation Portal or its employees shall make no recommendations regarding names for trademark filing and cannot confirm the availability or guarantee registration.
    • It shall be the client’s responsibility to confirm the accuracy of the information provided in trademark forms. Taxation Portal disclaims all liability with regard to information that is incomplete or false.
    • Taxation Portal shall not be held responsible for any objections, refusals, oppositions, or other issues that may arise during the trademark registration process. The client acknowledges that such matters are beyond the control of Taxation Portal.
    • Taxation Portal cannot guarantee that the trademark will be accepted or registered by the Trademarks Office and/or through the objection reply process. The acceptance and registration of a trademark are subject to the discretion and approval of the Trademarks Office. While Taxation Portal will make reasonable efforts to assist the client throughout the process, ultimate approval is not guaranteed.
    • The client is responsible for tracking the status of their trademark application on the IP INDIA portal. Taxation Portal may provide assistance or guidance, upon request.
    • Taxation Portal cannot be held accountable for Show Cause Hearings or other issues that may arise during the Objection process. The client acknowledges that such matters are beyond Taxation Portal’ control.
    • Taxation Portal will maintain client data confidentiality unless compelled by a court, administrative agency, or other governmental body.
